Council's Property team handles the lease associated with each jetty, boat ramp or pontoon erected in canals owned by Council. When planning approval is issued for the water recreation structure, the Property team drafts and issues the corresponding lease agreement.
These leases are issued for 5 year terms, therefore they need to be renewed every 5 years.
Once the water recreation structure owner and Council have both signed the lease agreement, the jetty, boat ramp or pontoon owner is invoiced their lease application fee and the first years lease fee. When the lease is renewed at the end of the 5 year term, a renewal application fee must be paid.
Jetty owners must provide Council with a copy of their public liability insurance for a minimum of $20m. When their public liability is renewed annually, a copy of their updated certificate must be forwarded to Council.
If water recreation structure owners wish to modify their structures, they require approval from Council's Property team as the Lessor, even if the modification is DA exempt.
