Making a Planning Proposal
Where a development is not permitted under the Clarence Valley Local Environmental Plan 2011, an amendment is needed to make it possible.
The first step in this process is to submit a planning proposal (also known as a rezoning application) and the appropriate fee to Council.
The Planning Proposal should:
- explain the intended effect of a proposed local environmental plan (LEP); and
- outline potential amendments to the current LEP and the justification for doing so.
We as a council must support a Planning Proposal before it can proceed further. If supported, it will be referred to the NSW Department of Planning and Environment’s planning gateway, which will issue a Gateway determination to proceed (subject to specified conditions) or not proceed.
Before the formal exhibition of a planning proposal, we will first consult with public authorities specified in the Gateway. We will also publicly exhibit and undertake community and other stakeholder consultation as directed in any Gateway determination. Exhibition/consultation periods usually range between 14-28 days.
